LiBFans Terms of Use

These terms of use (hereinafter referred to as "Terms of Use") apply to the service named "LiBfans" (hereinafter referred to as "Service") operated by LiBfans. This Terms of Use (hereinafter referred to as the "Terms of Use") sets forth the terms and conditions for the use of the service named "LiBfans" (hereinafter referred to as the "Service") operated by LiBfans. The "Terms and Conditions of Use" (hereinafter referred to as the "Terms and Conditions") set forth the terms and conditions for the use of the service (hereinafter referred to as the "Service") on the website "LiBfans" operated by LiBfans. A person who has registered to use the Service in accordance with Article 2 (hereinafter referred to as a "Registered User") The person who registers for use of the Service pursuant to Article 2 (hereinafter referred to as "Registered User") shall use the Service in accordance with these Terms of Use.

Article 1 (Application)
These Terms of Use shall apply to all relationships between the Registered User and LiBfans regarding the use of the Service.

Article 2 (Registration for Use)

    Any person who wishes to use the Service (hereinafter referred to as "Prospective Registered User") (hereinafter referred to as "Registration") agrees to abide by these Terms of Use and submits certain information as specified by LiBfans (hereinafter referred to as "Registration Information") to LiBfans. The applicant (the "Applicant") agrees to abide by these Terms and Conditions and provides LiBfans with certain information as determined by LiBfans (the "Registration Information").
    The registration for use of the Service shall be completed when the applicant applies for the registration for use of the Service in the manner prescribed by LiBfans and when LiBfans approves the application.

LiBfans may not approve an application for registration if it determines that the applicant has any of the following reasons, and shall not be obligated to disclose the reasons for such denial. (1) LiBfans deems the registration to be inappropriate.

    Upon completion of the registration, a contract for the use of the Service in accordance with the provisions of this Agreement (hereinafter referred to as the "Usage Contract") will be established between the registered user and LiBfans. (hereinafter referred to as the "Usage Contract") shall be established between the Registered User and LiBfans.

Article 3 (Management of User ID and Password)

    Registered Users shall manage their user IDs and passwords for the Service at their own responsibility.
    The Registered User shall not, under any circumstances, transfer or lend his/her user ID and password to any third party.
    LiBfans may consider the use of the Service by the registered user himself/herself when the combination of user ID and password matches the registered information and the user logs in.
    LiBfans shall not be liable for any damage caused by inadequate management of the password or registered e-mail address, errors in use, or use by a third party, and the registered user shall be responsible for any such damage.
    When a registered e-mail address is no longer under the control of the registered user, the registered user shall change the e-mail address to a usable e-mail address that is under the control of the registered user.

Article 4 (Prohibited Matters)
In using the Service, Registered Users shall not engage in any of the following acts (1) Violate the laws of the Nederland (2) Any action that LiBfans does not approve of

    LiBfans reserves the right to suspend or discontinue all or part of the Service without prior notice to the Registered User in the event that LiBfans determines any of the following to be the case

(1) When LiBfans conducts maintenance checks or updates of the computer systems related to the Service (2) When the Service is difficult to provide due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters (3) When computers or communication lines are down due to accidents (4) When LiBfans otherwise deems it difficult to provide the Service (4) In any other cases in which LiBfans deems it difficult to provide the Service.

    LiBfans shall not be liable for any loss or damage incurred by the registered user or any third party due to the suspension or interruption of this service, regardless of the reason.

Article 6 (Restriction of Use and Cancellation of Registration)

    LiBfans may, without prior notice, delete posted data, restrict a registered user from using all or part of the Service, or terminate the user's registration as a registered user, in the following cases

(1) If you violate any of the terms of this Agreement (2) If you have not used the Service for more than one year (3) If you have not responded to any inquiries or other communications from LiBfans for more than 30 days (4) If you fall under any of the items of Article 2.2 (4) If LiBfans otherwise deems your use of the Service inappropriate (4) Any other cases in which LiBfans deems the use of the Service to be inappropriate.

    In the event of any of the above, the Registered User shall lose the benefit of time for all debts owed to LiBfans and shall immediately repay all debts owed to LiBfans at that time in a lump sum.
    LiBfans shall not be liable for any damages incurred by the registered user as a result of any action taken by LiBfans in accordance with this article.

Article 7 (Disclaimer of Warranty and Disclaimer of Liability)

    LiBfans does not warrant that the Service will be free from defects in fact or law (including, but not limited to, defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors or bugs, infringement of rights, etc.), even if LiBfans expressly or implicitly disclaims any such defects. 

    LiBfans shall not be liable for any transaction, communication, or dispute between a registered user and another registered user or a third party with respect to the Service.
    The Service may be linked with services provided by other entities such as Twitter (hereinafter referred to as "External Services"). LiBfans shall not be liable for any failure of the Service to link with External Services. In the event that the Service is linked to an external service, the registered user shall comply with the terms of use of the external service at the user's own expense and responsibility, and LiBfans shall not be liable for any dispute between the registered user and the operator of the external service in question. LiBfans shall not be liable for any dispute between a registered user and the operator of such external service.
    Registered Users shall investigate, at their own responsibility and expense, whether or not their use of the Service violates laws, regulations, internal rules of industry associations, etc. applicable to the Registered Users, and LiBfans shall not be liable for any guarantee that the use of the Service by the Registered Users complies with such laws, regulations, internal rules of industry associations, etc. applicable to the Registered Users. LiBfans does not guarantee that the use of the Service by the Registered User will comply with any applicable laws, regulations, internal rules of any industry association, or the like.
    Any transactions, communications, disputes, etc. between a Registered User and other Registered Users or other third parties in connection with the Services or the LiBfans Website shall be handled and resolved at the Registered User's own risk, and LiBfans shall not be liable for any such matters.
    LiBfans shall not be liable for any interruption, suspension, termination, unavailability or modification of the Service by LiBfans, deletion or loss of messages or information of registered users, cancellation of registration of registered users, loss of data or breakdown or damage to equipment due to use of the Service, or any other damages incurred by registered users in connection with the Service. LiBfans shall not be liable for any damages incurred by Registered Users in connection with the Service.
    LiBfans shall not be liable for any information obtained from any website other than the LiBfans website for any reason whatsoever, even if the LiBfans website provides links to other websites or links from other websites to the LiBfans website. LiBfans shall not be held liable for any reason whatsoever for any other website or any information obtained from such other website.
    In the event of a slowdown in display speed or failure due to excessive access or other unforeseen factors (including the loss for any reason of text, images, videos, or other data posted or transmitted by registered users on the Service), LiBfans shall not be liable for any loss or damage of any kind incurred. LiBfans shall not be liable for any loss or damage caused by such factors.
    LiBfans is not obligated to monitor or store any text, images, videos, or other data posted or transmitted by registered users on the Service.
    LiBfans shall not be held liable for any inquiries regarding intellectual property rights such as copyrights and trademarks, personal rights such as honor, trust, and privacy, or any other rights infringement that may arise between LiBfans and a third party in connection with the content of any postings. The contributor shall resolve such inquiries at his/her own cost and responsibility.
    LiBfans shall not be liable for any damages incurred by registered users in connection with the service. Even in the event that LiBfans is liable to a registered user for damages notwithstanding the provisions of this paragraph or any other provisions exempting LiBfans from liability for damages due to the application of the Consumer Contract Act or any other reason, LiBfans' liability shall be limited to a period of one month from the time the cause of the damages arose to the extent that LiBfans has been notified by the registered user that such damages have arisen. In the event that LiBfans does not receive any commission (as defined in Article 13) from the registered user for a period of one (1) month from the time the damage occurred, LiBfans' liability shall be limited to one hundred (100) yen.
    LiBfans shall not be liable to compensate any User for any damage caused by the enactment or change of any law, government ordinance, statute, rule, order, notice, ordinance, guideline, or other regulation regarding virtual currency.

Article 8 (User's Liability for Compensation, etc.)

    The Registered User shall indemnify LiBfans for any damages caused to LiBfans as a result of the Registered User's violation of these Terms of Use or in connection with the use of the Service.
    If a Registered User receives a claim from or has a dispute with another Registered User or any other third party in connection with the Services, the Registered User shall immediately notify LiBfans of the details of such claim or dispute, handle such claim or dispute at the Registered User's expense and responsibility, and notify LiBfans of the progress and outcome of the dispute upon request from LiBfans. LiBfans shall, upon request, report to LiBfans on the progress and outcome of the claim or dispute.
    If LiBfans receives any claim from another Registered User or any other third party for infringement or any other reason in connection with the Registered User's use of the Services, the Registered User shall indemnify LiBfans for any amounts that LiBfans is forced to pay to such third party based on such claim. LiBfans shall not be liable for any damages of any nature whatsoever.

Article 9 (Profile, Message Function, etc.)

    LiBfans provides registered users with profile pages, message functions, etc. on the Site. Registered Users may create, edit and publish their profile pages and send messages using the message function in the manner and to the extent prescribed by LiBfans.
    The User agrees in advance that his/her profile page will be made public on the Site.
    Users shall not post or transmit any of the following types of posted data, and LiBfans reserves the right to delete all or part of a user's posted data or terminate the user registration of such user if LiBfans determines that any of the following applies to the user

LiBfans reserves the right to delete all or part of the posted data or terminate the user's registration if LiBfans determines that the posted data falls under any of the following categories: (1) Information that could personally identify the user, such as name, e-mail address, address, telephone number, or SNS ID of the user or a third party; (2) Information that infringes or may infringe on the copyright, portrait rights, privacy rights, trademark rights, honor rights, or other rights of a third party; (3) False or untrue information; (4) The Services or other information that LiBfans provides, (5) Any other expressions or contents that fall under Article 4 (Prohibited Acts).
Article 10 (Fan Club)

    Registered Users may establish a fan club (Pages) on the Service by applying in the manner prescribed by LiBfans. The Registered User who opens a Fan Club on the Service is hereinafter referred to as the "Fan Club Owner.
    The Fan Club Owner shall pay the Fan Club membership fee paid by the registered user who joins the Fan Club (hereinafter referred to as "Fan Club Member") in accordance with the method determined by LiBfans. The Fan Club Establisher shall pay the membership fee for the Fan Club ("Fan Club Membership Fee") paid by the registered user who joins the Fan Club ("Fan Club Member") in a manner determined by LiBfans. The amount of the Fan Club membership fee ("Fan Club Membership Fee") paid by the registered user who joins the Fan Club ("Fan Club Member"), the details of the Fan Club privileges provided to the Fan Club Member ("Membership Privileges"), the validity period of the agreement, the validity period of the agreement, and the amount of the membership fee. The Fan Club Membership Fee shall specify the amount of the Fan Club membership fee (hereinafter referred to as the "Fan Club Membership Fee"), the period of validity of the agreement, whether the agreement is automatically renewed upon expiration of the validity period, and other details of the Fan Club.
    A contract (hereinafter referred to as the "Fan Club Membership Contract") between a Fan Club Member and the FAN CLUB Founder, which includes the membership fee, membership privileges, validity period, whether or not the contract is automatically renewed, and other matters determined by the FAN CLUB Founder in accordance with the preceding paragraph, shall be established at the time of admission to membership. The Fan Club Establisher and the Fan Club Member shall be deemed to be in agreement.
    The FAN CLUB Founder and FAN CLUB Members acknowledge and agree that LiBfans is not a party to the FAN CLUB Membership Agreement and that LiBfans is not responsible for the contents and performance of the FAN CLUB Membership Agreement.
    Once the Fan Club Membership Agreement has been concluded in accordance with Paragraph 3, the Fan Club Member may not cancel the Fan Club Membership Agreement.
    The Fan Club Membership Agreement that is subject to automatic renewal shall be automatically renewed for the period specified in the Fan Club Membership Agreement, unless the Fan Club Founder or Fan Club Member indicates otherwise in a manner determined by LiBfans at least one week prior to the expiration of the valid period, and the same shall apply thereafter. The same shall apply thereafter.
    The Fan Club Establisher shall properly perform its obligations to Fan Club Members based on the Fan Club Membership Agreement, including the provision of membership benefits to Fan Club Members.
    In establishing FAN CLUB, FAN CLUB Founder shall comply with the Act on Specified Commercial Transactions and other applicable laws and regulations.
    If the FAN CLUB Founder does not properly perform his/her obligations under the FAN CLUB Membership Agreement, if the FAN CLUB Member does not pay the FAN CLUB Membership Fee, or if LiBfans otherwise deems it inappropriate to continue the FAN CLUB Membership Agreement, LiBfans shall cancel the FAN CLUB Membership Agreement between the FAN CLUB Founder and the FAN CLUB Member. LiBfans may terminate the Fan Club Membership Agreement between the Fan Club Owner and the Fan Club Member in the event that the Fan Club Member fails to pay the membership fee.

Article 11 (Sale of Products)

    Registered Users may sell their products or services (hereinafter referred to as "Products") on the Service in a manner determined by LiBfans. The registered user may sell the products or services (hereinafter referred to as "Products") to the fan club members and other registered users recognized by LiBfans on the Service in a manner determined by LiBfans. The registered user who sells the Product pursuant to this paragraph is hereinafter referred to as the "Seller.
    In selling the Products pursuant to the preceding paragraph, the Seller shall determine the consideration for the Products (hereinafter referred to as the "Purchase Price") in a manner determined by LiBfans. The Seller shall determine the price of the Product ("Purchase Price") in a manner determined by LiBfans.
    When a fan club member or other registered user authorized by LiBfans purchases a Product sold by the Vendor in a manner determined by LiBfans, a contract for the purchase of the Product ("Purchase Contract") shall be established between said registered user and said fan club founder. The registered user and the FANCLUB Establisher shall enter into a contract for the purchase of the Product (the "Purchase Contract"). The Registered User who purchases the Product pursuant to the provisions of this Article shall hereinafter be referred to as the "Purchaser.
    The Seller and the Purchaser acknowledge and agree that LiBfans is not a party to the Purchase Agreement and that LiBfans is not responsible for the content and performance of the Purchase Agreement.
    Once a purchase contract has been concluded pursuant to Paragraph 3, the Buyer may not cancel the purchase contract, return the Product, or exchange it for another product.
    The Vendor shall properly perform its obligations to the Buyer under the purchase contract with the Buyer, including the mailing of the Products and the provision of services.
    In selling the Products, the Vendor shall comply with the Act on Specified Commercial Transactions and other applicable laws and regulations.
    LiBfans may terminate the purchase contract between the Vendor and the Buyer if the Vendor does not properly perform its obligations under the purchase contract, if the Buyer does not pay the purchase price, or if LiBfans otherwise deems it inappropriate to continue the purchase contract.

Article 12 (Fan Club Membership Fee and Purchase Price)

    The Fan Club Member shall pay the Fan Club membership fee (consumption tax included) on the date of admission to the Fan Club (however, if LiBfans specifies a separate payment date, such date shall be the payment date). The Fan Club membership fee (including the amount equivalent to consumption tax. The same shall apply hereinafter in this Article) on the date of admission to the Fan Club. The Fan Club membership fee (including the amount equivalent to consumption tax; the same shall apply hereinafter in this Article) shall be paid in the manner designated by LiBfans. In the event that the Fan Club Membership Agreement is automatically renewed in accordance with the provisions of Article 10, Paragraph 6, the Fan Club Member shall pay the Fan Club Membership Fee on the renewal date (or, if LiBfans has separately designated a payment date, on the relevant payment date). The same shall apply thereafter. The Fan Club Member shall bear the cost of payment. In the event that the Fan Club Membership Agreement is terminated during the valid period of the Fan Club Membership Agreement (including the period of validity after automatic renewal) or for any other reason, the Fan Club Membership Fee shall be paid by the Fan Club Member. The Fan Club membership fee shall not be prorated even if the Fan Club membership contract is terminated during the valid period of the Fan Club membership contract (including the valid period after automatic renewal) due to cancellation or other reasons.
    When the Purchaser purchases the Product from the Seller pursuant to Article 11.3, the Purchaser shall immediately pay the purchase price by the method designated by LiBfans. The costs of payment shall be borne by the Purchaser.
    LiBfans shall have the authority to accept the Fan Club membership fee and the purchase price on behalf of the Buyer and to sub-contract such acceptance to a third party designated by LiBfans (together with LiBfans, hereinafter referred to as the "Sub-Recipient"). The proxy recipient shall have the authority to sub-consign the receipt of membership fee and purchase price to a third party designated by LiBfans (together with LiBfans, the "proxy recipient"). The obligation of a Fan Club Member to pay the Fan Club Membership Fee shall be extinguished when the Sub-Recipient receives the Fan Club Membership Fee from the Fan Club Member. LiBfans shall also extinguish the Buyer's obligation to pay the purchase price upon receipt of the purchase price from the Buyer by the Sub-Recipient.
    LiBfans shall make an application for payment from the Fanclub Member or the Seller in the manner determined by LiBfans (hereinafter referred to as "Application for Payment"). In the event that LiBfans receives an application for payment from the Fan Club Establisher or Seller (hereinafter referred to as "Application for Payment"), the amount to be paid shall mean the amount of Fan Club membership fee received by the proxy recipient pursuant to the preceding paragraph for the period from the first to the last day of each month. (Hereinafter referred to as "Amount Subject to Payment".) LiBfans shall make payment to the Fan Club Owner and Seller by bank transfer or other method designated by LiBfans as soon as the application for payment is received from the Fan Club Owner and Seller. LiBfans shall transfer the payment amount to the Fan Club Owner or Seller by the last day of the following month if the application for payment is received by the 15th day of the month, and by the last day of the month following the month if the application for payment is received after the 15th day of the month.
    Notwithstanding the provisions of the preceding paragraph, the Fanclub Establisher and Seller may not apply to LiBfans for payment of the transfer if the amount of the unpaid payment target minus the fee stipulated in the following Article is less than the stipulated amount. No interest shall accrue on the unpaid amount due as a result of such deferral.
    In the event that the contract of use between LiBfans and the Vendor is terminated due to termination of membership registration or any other reason, LiBfans shall not be obligated to pay the Vendor any unpaid amount due.
    In the event that no application for payment has been made by the Fan Club Establisher for more than one (1) year from the time when the first Fan Club membership fee was incurred for the Fan Club established by the Fan Club Establisher (including the case where the payment application cannot be made pursuant to the provisions of Paragraph 4. The same shall apply hereinafter in this paragraph). If LiBfans does not receive a payment request from the Fan Club Owner for more than one year from the time of the first occurrence of the Fan Club Membership Fee or from the time of the last transfer of the amount due from LiBfans to the Fan Club Owner, LiBfans may deem that the Fan Club Owner has waived his/her right to claim the amount due from LiBfans.

Article 13 (Commission)

    The FAN CLUB Founder and the Vendor shall pay to LiBfans as compensation for the use of the Service (hereinafter referred to as "Commission") LiBfans shall pay to the Seller an amount equal to the amount to be paid multiplied by a percentage determined separately by LiBfans on the LiBfans website as compensation for the use of the Service (the "Commission").
    LiBfans may substitute the receipt of the Commission by deducting the Commission stipulated in the preceding paragraph from the amount payable to the Vendor under the preceding Article.
    LiBfans may substitute the receipt of bank transfer fees by deducting such bank transfer fees from the amount payable to the Fan Club Owner and the Vendor in accordance with the preceding article. Article 14.

Article 14 (Change of Service Contents, etc.)
LiBfans may change the contents of the Service or terminate the provision of the Service without notice to the Registered User, and shall not be liable for any damages incurred by the Registered User as a result thereof.
Article 15 (Modification of Terms and Conditions)
LiBfans may modify these Terms of Use (including the rules and regulations regarding the Service posted on the LiBfans website) without prior notice to the Registered User. LiBfans may revise these Terms and Conditions at any time without prior notice to registered users.) LiBfans reserves the right to revise these Terms of Use at any time without prior notice to registered users. Registered Users are obligated to review the Terms each time they access the Service. Continued use of the Service after any modification of the Terms indicates acceptance of all changes and agreement to be bound by them.
Article 16 (Severability)
If any provision of this Agreement or part thereof is determined to be invalid or unenforceable under the Consumer Contract Act or any other law or regulation, the remaining provisions of this Agreement and the remainder of any provision that is determined to be invalid or unenforceable in part shall remain in full force and effect, and LiBfans and Registered Users shall not be liable for the invalidity of such LiBfans and Registered Users shall endeavor to modify such invalid or unenforceable provision or portion to the extent necessary to make it legal and enforceable, and to ensure that the intent, legal and economic effect of such invalid or unenforceable provision or portion is equivalent.
Article 17 (Confidentiality)

    The term "Confidential Information" as used herein shall mean all information regarding LiBfans' technology, business, operations, finances, organization, and any other matters that the Registered User has been provided or disclosed by LiBfans in writing, orally, or through recorded media, or otherwise becomes aware of, in connection with the User Agreement or the Services. (1) information provided or disclosed by LiBfans in writing or in oral or recorded media or otherwise However, (1) information that was or had become generally known to the public at the time it was provided or disclosed by LiBfans or became known to the public, (2) information that became known to the public through publications or otherwise through no fault of its own after it was provided or disclosed by LiBfans or became known to the public, (3) information that was not disclosed by LiBfans or became known to the public through no fault of its own, (4) information that was not provided or disclosed by LiBfans or became known to the public through no fault of its own, (5) information that was not provided or disclosed by LiBfans or became known to the public through no fault of its own. (3) acquired lawfully from a third party authorized to provide or disclose the Confidential Information without being obligated to maintain confidentiality, (4) developed independently without the use of Confidential Information, and (5) confirmed in writing by LiBfans that confidentiality is not required, shall be excluded from Confidential Information.
    Registered Users shall use Confidential Information solely for the purpose of using the Services and shall not provide, disclose or divulge LiBfans' Confidential Information to any third party without LiBfans' written consent.
    Notwithstanding the provisions of paragraph 2, Registered Users may disclose Confidential Information upon order, request or demand of any law, court or government agency. Notwithstanding the provisions of Section 2, Registered Users shall promptly notify LiBfans of any such order, request, or demand.
    Registered Users shall obtain the prior written consent of LiBfans before reproducing any document or magnetic recording medium containing Confidential Information, and shall strictly manage the reproductions in accordance with Section 2.
    Whenever requested by LiBfans, the Registered User shall, without delay and in accordance with LiBfans' instructions, return or destroy the Confidential Information and any documents or other recorded media containing or containing the Confidential Information and all copies thereof.

Article 18 (Attribution of Rights)

    All ownership and intellectual property rights in and to the LiBfans Website and the Services are the property of LiBfans or its licensors, and the license to use the Services pursuant to the registration set forth in these Terms of Use shall not be construed as a license to use the LiBfans Website or the Services. The permission to use the Services pursuant to registration under these Terms of Use does not constitute a license to use any intellectual property rights of LiBfans or any other party that has granted a license to LiBfans with respect to the LiBfans Website or the Services. Registered Users shall not, for any reason, engage in any activity that may infringe the intellectual property rights of LiBfans or any other party licensed to LiBfans (including, but not limited to, disassembling, decompiling, reverse engineering). You shall not do any of the following
    Any text, images, videos or other data posted or transmitted by a registered user on the LiBfans website or the service shall be the property of the registered user or the person who has granted the registered user the right to use such data. However, LiBfans shall be free to use (including reproduction, copying, modification, sublicensing to third parties, and any other use) any text, images, videos, or other data posted or transmitted by a registered user on the LiBfans website or the Service with the permission of the registered user without compensation. Article 19 (Handling of Personal Information, etc.)

Article 19 (Handling of Personal Information, etc.)

    The Registered User agrees that his/her personal information contained in the Registration Information shall be handled in accordance with LiBfans' Privacy Policy.
    LiBfans shall anonymize information obtained in the course of providing the Service in such a way that specific individuals cannot be identified, and shall be free to use such information (including, but not limited to, providing it to third parties) as statistical information and other information. (2) The Service may be used freely as statistical information or other information (including, but not limited to, providing such information to third parties) after anonymizing the information obtained in providing the Service so that specific individuals cannot be identified.

Article 20 (Notes on Downloading, etc.)
When the Registered User downloads or otherwise installs software, etc. from the LiBfans website or installs such software, etc. on the Registered User's computer, etc. during the start of use of the Service or while using the Service, the Registered User shall take sufficient care not to delete or alter the information held by the Registered User or cause malfunction or damage to the equipment. LiBfans shall not be liable for any damage caused to the registered user.
Article 21 (Term of Validity)
The User Agreement shall become effective on the date of registration of the Registered User in accordance with Article 2 and shall remain in effect between LiBfans and the Registered User until the date of cancellation of the registration of the Registered User or the termination of the provision of the Service, whichever is earlier.
Article 22 (Survival Provision)
The provisions of Articles 3, 5.2, 6.2 and 6.3, 7, 8, 10.9, 11.8, 12 and 13 (limited to cases of non-payment), 16 through 20, 22, 24, and 25 shall survive the termination of the User Agreement.
Article 23 (Notification or Communication)
Notices or communications between the Registered User and LiBfans shall be made in a manner determined by LiBfans.
Article 24 (Prohibition of transfer of rights and obligations)

    The Registered User may not assign his/her position under the User Agreement or his/her rights or obligations under these Terms of Use to a third party or offer them as security without the prior written consent of LiBfans.
    In the event that LiBfans transfers the business of this service to another company, LiBfans may transfer the status of the user contract, rights and obligations under these Terms of Use, and registered user registration information and other customer information to the transferee of such business transfer, and the registered user agrees to such transfer in advance in this section. Registered Users shall be deemed to have consented to such transfer in advance in this paragraph. The business transfer stipulated in this section shall include not only ordinary business transfers, but also corporate divestitures and any other cases in which business is transferred.

Article 25 (Governing Law and Jurisdiction)
This Agreement shall be governed by and construed in accordance with the laws of the Nederland. This service is not provided for commercial purposes.

Even if a user violates all terms and conditions, LiBFans will not pursue responsibility against the user.
